Dubsea Terms & Conditions

1. All Sales Are Final

All sales, payments, and fees associated with Dubsea submissions are strictly final and non-refundable, without exception.

This includes, but is not limited to:

• Submissions that are denied, delayed, or not posted
• Posts that receive lower-than-expected engagement or visibility
• Posts that are removed, altered, or archived
• Client dissatisfaction with timing, placement, or creative presentation

Dubsea does not issue refunds, partial refunds, or credits under any circumstance once payment has been received.

2. Submission Does Not Guarantee Posting

All submissions through Dubsea.com are treated as requests for consideration. Dubsea reserves full discretion to accept, reject, modify, or decline any campaign submission for any reason.

Payment covers administrative, creative, and processing costs — not guaranteed publication. If a campaign is declined, the payment remains non-refundable, as review and evaluation time are considered part of the paid service.

3. No Performance Guarantees

Dubsea makes no promises, warranties, or guarantees regarding the results, engagement, impressions, or success of any post or campaign.

This includes, but is not limited to:

• Likes, comments, shares, views, or traffic
• Sales, leads, or conversions
• Long-term exposure or viral performance

All placements and promotions are provided on an "as-is" and "as-available" basis. Dubsea is not responsible for the performance of any post once it is published.

4. Post Duration

Dubsea does not guarantee that any post will remain live on any Dubsea page for more than 24 hours. Posts may be removed, edited, rescheduled, or archived at any time without notice, for any reason, including but not limited to:

• Content moderation or page layout adjustments
• Platform algorithm changes or community standards
• Strategic updates or replacement campaigns

Dubsea is not liable for any loss or perceived loss resulting from post removal, timing, or visibility.

5. No Refunds Under Any Circumstances

Dubsea maintains a zero-refund policy for all transactions. No refunds will be issued for:

• Declined submissions
• Delayed or rescheduled posts
• Posts that do not meet user expectations
• Technical issues outside Dubsea's control
• Client changes of mind, dissatisfaction, or disputes after purchase

This policy applies regardless of outcome, timing, or service level. By submitting payment, you agree that all sales are final and non-refundable.

6. Intellectual Property & Content Rights

By submitting content (including text, photos, videos, graphics, or files), you represent and warrant that:

• You own or have permission to use all submitted materials.
• Your submission does not infringe upon any copyright, trademark, or publicity right.
• Dubsea has the right to modify, reproduce, and distribute your content for promotional or editorial purposes.

You grant Dubsea a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, edit, and display the submitted materials across Dubsea's social platforms, website, and promotional media.

7. Creative and Editorial Control

Dubsea reserves full creative discretion regarding caption writing, formatting, placement, tagging, scheduling, and other aspects of presentation. While Dubsea may communicate with you for approval, the final creative decisions rest solely with Dubsea.

Submission and payment do not entitle the customer to direct control over post wording, layout, or positioning.

8. Communication and Approval

After your submission, Dubsea may contact you via email, text, or phone to confirm or clarify campaign details. If you fail to respond within a reasonable timeframe (typically 48 hours), Dubsea may delay or cancel the post without refund.

Once a post has been approved and/or published, no edits, revisions, or refunds will be provided.

9. Rush and Collaboration Fees

Rush Fee ($99): Applies when a post is requested within 48 hours of submission.

Collaboration Fee ($899): Applies when a user selects a "Collab with @Dubsea" upgrade for cross-platform posting. All additional fees are final and non-refundable once processed.

10. Limitation of Liability

To the fullest extent permitted by law, Dubsea, its owners, affiliates, employees, and partners shall not be held liable for:

• Any damages, losses, or claims arising from the use of Dubsea services;
• Any indirect, incidental, special, consequential, or punitive damages;
• Platform issues, social media downtime, or algorithmic changes beyond Dubsea's control.

Your sole remedy for dissatisfaction is discontinuing the use of Dubsea services.

11. Indemnification

You agree to indemnify, defend, and hold harmless Dubsea, its affiliates, directors, and representatives from any claims, damages, losses, or legal expenses arising out of your:

• Submitted content or materials
• Breach of this Agreement
• Violation of any law or third-party rights

This includes all reasonable attorney's fees and associated legal costs.

12. Service Modifications and Termination

Dubsea reserves the right to modify, suspend, or discontinue any aspect of its services at any time, without notice. We may terminate or deny access to any client found violating these terms or submitting prohibited content.

13. Governing Law

These Terms and Conditions are governed by and construed under the laws of the State of Washington, United States, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in King County, Washington.

14. Entire Agreement

This document represents the entire agreement between you and Dubsea. No oral statements, external promises, or implied representations shall modify these terms. Dubsea reserves the right to update or change these Terms at any time, and continued use of the service constitutes acceptance of the latest version.

15. Acknowledgment

By checking the box on the submission form, you confirm that you:

• Have read, understood, and agreed to all Terms & Conditions above.
• Acknowledge that all payments are non-refundable.
• Understand that nothing is promised, guaranteed, or ensured.
• Agree that this submission is a paid request for consideration, not a guaranteed publication or result.
